These Terms of Service (“Terms”) govern your access to and use of the GarajApp website, mobile applications, and related services (collectively, the “Platform”) operated by GarajApp (“GarajApp,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.
1. Overview of the Platform
GarajApp is an online marketplace that connects individuals or businesses (“Hosts”) offering garage or similar storage/workspace for rent with individuals or businesses (“Renters”) seeking such spaces. GarajApp does not own, operate, manage, or control any listings and is not a party to agreements between Hosts and Renters.
2. Eligibility
You must be at least 18 years old and legally capable of entering into contracts to use the Platform. By using GarajApp, you represent and warrant that you meet these requirements.
3. Account Registration
You must create an account to use certain features of the Platform. You agree to:
- Provide accurate and complete information
- Maintain the security of your login credentials
- Notify us immediately of unauthorized account use
GarajApp is not responsible for losses caused by unauthorized account access.
4. Host Obligations
If you list a space on GarajApp, you represent and warrant that:
- You have the legal right to rent the space
- The space complies with applicable laws, zoning, and safety regulations
- Listing information is accurate and up to date
- Any additional Host-specific terms are lawful and disclosed prior to booking
Hosts are solely responsible for their listings, pricing, availability, and compliance with all applicable laws.
5. Renter Obligations
Renters agree to:
- Use the rented space only for lawful purposes
- Comply with Host rules and listing terms
- Not store prohibited or hazardous materials unless expressly permitted
- Vacate the space on time and in agreed condition
Renters are responsible for any damage caused to the Host’s property.
6. Bookings, Payments, and Fees
GarajApp facilitates payments between Renters and Hosts and may charge:
- Service fees
- Commission fees
- Subscription or listing fees
All fees are disclosed before booking. Payments are processed through third-party payment providers. GarajApp does not store payment card information.
7. Cancellations and Refunds
Cancellation and refund policies are determined by:
- GarajApp’s platform-wide policies
- Host-specific terms disclosed at booking
GarajApp may issue refunds at its discretion in cases involving fraud, system errors, or policy violations.
8. Disputes Between Users
GarajApp may offer a dispute resolution process. However:
- GarajApp is not responsible for resolving disputes
- We may review evidence and apply automated rules
- Our decision is final for platform-related remedies
Users retain the right to pursue legal action independently.
9. Insurance and Risk Acknowledgment
GarajApp does not provide insurance coverage. Hosts and Renters are strongly encouraged to obtain appropriate insurance.
You acknowledge that use of rented spaces carries inherent risks and agree that GarajApp is not responsible for injury, loss, theft, or damage.
10. Prohibited Activities
You agree not to:
- Use the Platform for illegal activities
- Provide false or misleading information
- Circumvent platform fees
- Harass, threaten, or defraud others
- Interfere with platform security or operations
Violation may result in suspension or termination.
11. Suspension and Termination
GarajApp may suspend or terminate accounts at any time for:
- Violations of these Terms
- Fraudulent or harmful behavior
- Legal or regulatory concerns
Termination does not eliminate outstanding obligations.
12. Intellectual Property
All Platform content, trademarks, logos, and software are owned by GarajApp or its licensors. You may not copy, modify, or distribute content without written permission.
13. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” GARAJAPP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GARAJAPP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
GARAJAPP’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF FEES PAID TO GARAJAPP BY YOU IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
15. Indemnification
You agree to indemnify and hold harmless GarajApp from claims, damages, losses, and expenses arising from:
- Your use of the Platform
- Your violation of these Terms
- Your interactions with other users
16. Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any legal action must be brought in courts located in Illinois.
17. Changes to These Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance.
